Under the Mortgage Forgiveness Debt Relief Act of 2007, federal taxpayers are able to exclude certain discharges of debt on their primary residence from their taxes. This "discharge of debt" includes debt reduced through foreclosure and debt reduced through mortgage restructuring.

Please note, the Mortgage Forgiveness Debt Relief Act only applies to debt forgiven in 2007-2009. According to the IRS, the debt in question must have been used to "buy, build or substantially improve the taxpayer's principal residence and must have been secured by that residence."
