Errors on credit reports are rampant, but they are especially common after completing a bankruptcy. The credit report should show a "0" balance for any discharged debts. Your creditors and debt collectors should report the discharge of your debts a certain way, but too often, they simply don't.

Whether or not a credit report error comes after a bankruptcy, it is then the responsibility of the credit reporting agency (Experian, Equifax, or Transunion) to correct their records. The Fair Credit Reporting Act (FCRA) of 2003 explicitly states that failing to take steps to correct false information is a fair credit violation.

The first step you must take is to send the credit reporting agency a letter telling it about the error. See our Forms page for a sample letter you can use. Frankly, you do not need to hire a lawyer to do this.

However, if the erroneous information is not removed from your credit report you may need the assistance of a lawyer. Attorney Lawrence L.
