The Age of the Debt Is Key

The key to taxes and bankruptcy lies in how old the tax debt is.. No less than three different criteria come into play:

• The length of time since the return was due
• The length of time since the return was filed
• The length of time since the tax was assessed

Federal tax debt can be discharged if the return was due more than three years before you file for a Chapter 7 bankruptcy. Also, the return had to be filed two years before, and the tax assessed 240 days before the filing. However, if you have filed a fraudulent return or have willfully attempted to evade taxes, your tax debt will not be discharged
